A jury on Friday found Michael Delaney, 49, of 720 E. Crescent St. in Wheaton guilty of first-degree murder for the 2009 stabbing of Micheal Scalzo. Delaney stabbed Scalzo six times with a steak knife during a confrontation outside their Wheaton apartments on June 19, 2009. The fight was the culmination of a breakup between Delaney and ex-girlfriend Edita Pranckute earlier that week. Witnesses testified Wednesday that Scalzo had approached Delaney to defuse the escalating conflict between Delaney and Pranckute's new boyfriend, and was attacked when he turned to walk away. DuPage County Judge Daniel Guerin denied a motion Thursday in the Michael Delaney trial that prosecutors have failed to prove beyond a reasonable doubt the June 2009 murder of Michael Scalzo was pre-meditated. Delaney's defense filed the motion because "there is zero evidence" that he stabbed Scalzo in a pre-meditated or pre-calculated way, DuPage County Assistant Public Defender Brian Jacobs said Thursday. Prosecutors were asking for a pre-meditated murder decision, Jacobs said, based on Delaney’s prior actions toward people other than Scalzo, including his ex-girlfriend Edita Pranckute and her new boyfriend, Jonathan Nkhoma. Michael Delaney plans to argue it was self defense when he stabbed Michael Scalzo to death in June 2009 outside their Wheaton apartments as his first-degree murder trial continues this week. DuPage County Assistant Public Defender Brian Jacobs said Wednesday there is no question Delaney stabbed and killed Scalzo. "This is a trial about, 'Why?'" he said. "Michael (Delaney) believed he was being attacked at 8:30 (p.m.) by Michael Scalzo, and he had the ablity and the right to defend himself," he said. Wheaton man stands trial for the murdering of a neighbor in 2009.
Michael Delaney of Wheaton plans to argue self-defense when he stands trial for murder this week, the Daily Herald reported. Delaney is charged with the 2009 stabbing murder of Michael Scalzo outside an apartment in the 800 block of Crescent Street, according to the Chicago Tribune. A DuPage County Judge in September allowed testimony that Delaney has post-traumatic stress disorder after a 1980s military accident, the Daily Herald reported. Jury selection begins today. Opening statements could begin Wednesday, according to the Herald.
