Court Confirms Former Candidate is Ineligible for Write-in Campaign

Former City Council candidate Frank Garcia does not qualify to run a write-in campaign for City Council, judge says.

The City of Wheaton on Thursday won its lawsuit against the DuPage County Election Commission and former City Council candidate Frank Garcia, confirming the city's decision that Garcia does not qualify to run for office. Wheaton's municipal electoral board ruled last month that Garcia was ineligible to run for City Council because he was not a registered voter in the city of Wheaton when he filed Dec. 26 and therefore not considered a Wheaton resident. City to File Suit Against Former Candidate, Election Commission Over Write-in Candidacy

The City of Wheaton asks courts to confirm Frank Garcia is ineligible to run for City Council as a write-in candidate after he was removed from the ballot last month.

The City of Wheaton today will file a lawsuit against the DuPage County Election Commission and former At-Large City Council candidate Frank Garcia, asking that Garcia be deemed ineligible to run for Council as a write-in candidate after the city's decision to remove him from the spring election ballot. Wheaton's municipal electoral board ruled last month that Garcia was ineligible to run for City Council because he was not a registered voter in the city of Wheaton when he filed Dec. 26 and therefore not considered a Wheaton resident. What the law says is that a registered voter can challenge a candidate, which is what happened before - remember, the City of Wheaton did not sue to get Mr. Garcia kicked off the ballot. It does not say that a municipality can use tax money to sue people who "might" get elected as write-in candidates. City Council Candidate Removed From Ballot

A City Council candidate was removed from the ballot after an objection ruling over his voter registration status at the time of filing.

A municipal electoral board decided Monday to remove one At-Large City Council candidate's name from the ballot because he was not a registered voter in Wheaton when he filed as a candidate last month.  Candidate John Prendiville earlier this month filed an objection against his opponent, Frank Garcia, after finding Garcia was not a registered voter in Wheaton, and therefore did not meet the qualifications for candidacy. According to the City of Wheaton, candidates must be registered voters of the City of Wheaton and must live within city limits for at least one year. A municipal electoral board will review City Council candidate Frank Garcia's eligibility to run for City Council after John Prendiville filed an objection relating to his voter registration status.

A municipal electoral board will review one candidate’s objection to the other candidate’s eligibility to run for the At-Large City Council seat in the 2013 municipal election. John Prendiville said Wednesday his objection is that when his opponent, Frank Garcia, filed his nomination papers, he was not a registered voter in Wheaton and therefore does not qualify to run for office. Garcia, who filed for candidacy on Dec. 26, said he registered to vote in Wheaton about a week ago. According to the City of Wheaton, candidates must be registered voters of the City of Wheaton and must live within city limits for at least one year.
