Darien: The Dec. 17 hearing for Joseph Spitalli's arraignment in his murder case has been pushed back after a request for cameras in the courtroom was filed. Spitalli is charged in the November murder of a man dating Spitalli's ex-girlfriend. A motion has been filed seeking extended media coverage of Spitalli's arraignment. The judge set a Jan. 9 hearing on the media request, while scheduling the arraignment for Jan. 14, records show. Lisle: A grand jury has indicted a Lisle man on telephone harassment and aggravated battery charges stemming from an October incident involving a high school volleyball game. John Kasik is accused of leaving threatening messages for his daughter's volleyball coach at Lisle High School, and later bumping the school's athletic director during a meeting. Kasik is free on $300,000 bail with a scheduled court appearance - at which he will likely be arraigned - on Nov. 19. Wheaton: A Wheaton teen will undergo a sex offender evaluation as part of his case on charges he tried to arrange a meeting for sex with a young girl, court records show. Eric Pence was arrested in September after police investigated complaints from the girl's parents about Pence, who reportedly had lewd images of the girl on his phone. Prosecutors allege Pence wanted to meet the 12-year-old at the Wheaton Library for sexual activity. Pence has pleaded not guilty to child pornography, grooming and traveling to meet a minor charges. Wheaton: A 23-year-old Elgin woman faced felony theft and fraud charges after prosecutors accused her of stealing more than $500 from the DuPage County Employees Credit Union. Hermila Garcia, an employee at the financial institution, took the money in July after falsifying documents that said she transferred the money from her drawer to the vault. She was indicted last month of two counts each of theft, financial institution fraud and misappropriation of financial institution of property. She returns to court on Nov. 16. Downers Grove: A 51-year-old man, who last lived in Downers Grove, recently pleaded guilty to swindling money from an elderly resident. Metlow Miller admitted to one count of aggravated home repair fraud in connection to an April encounter with an 83-year-old man. Miller told the man he would fix cracks in his driveway and sidewalk for $32, but then told the man it would case nearly $1,300. The man paid Miller $950, although no work was performed. Miller received 180 days in DuPage County Jail, 24 months of probation and was ordered to pay restitution, as well as $650 in court costs. The following are recent developments in notable DuPage County court cases: Elmhurst—Diego Garcia wants a judge to clarify the sentencing range he faces on armed robbery charges tied to a pair of holdups in 2011. Garcia was told he was eligible for between 21 to 45 years if convicted in both cases, but the DuPage County Public Defender's Office, suggests the range should actually be six to 30 years because a 15-year add-on for using a weapon during an armed robbery is improper, according to court records. That's because being armed is a fundamental element of an armed robbery charge, and not something that enhances possible penalties, documents show. Elmhurst: An 18-year-old Bellwood man has pleaded not guilty to attempted predatory sex assault of a child and other charges in connection to an August incident in an Elmhurst park. Prosecutors allege Nikolai Anderson, who also is charged with sexual exploitation of a child and indecent solicitation of a child, exposed himself to two girls, ages 12 and 14, and asked one of the girls to perform a sex act. Anderson denied the charges during a Sept. 26 hearing. He returns to court in November. The following are recent developments in notable DuPage County court cases: Elmhurst: Sentencing has been set for the Elmhurst mother who pleaded guilty to aggravated battery to a child in connection to a June 2011 incident involving her son. Cheryl Luchetta had been charged with attempted murder after her she awoke to find her son unresponsive inside their Elmhurst home last year. Police and prosecutors said Luchetta drugged the boy before cutting her own throat. Luchetta pleaded guilty in July to the aggravated battery charge in a deal with prosecutors. The following are recent developments in notable DuPage County court cases: Wheaton—A judge recently denied the request by Gordon Vanderark to suppress his statements to authorities investigating threats he reportedly made against an assistant state's attorney and another judge. Vanderark had claimed prosecutors violated his rights and improperly questioned him about claims he tried to hire someone to kill the prosecutor and judge who handled an aggravated drunken driving case that landed Vanderark in prison.
