Wheaton Rape Suspect Seeks Bail Reduction

Three men charged in September incident in Wheaton apartment.

A 22-year-old Wheaton man accused of sexually assaulting a teen girl last year wants a judge to reduce his $1 million bail because of his family ties, which include a child born two weeks before his arrest.

Chet Magar and two other men—21-year-old Gyan Magar and 29-year-old Dambar Pithakotey—are charged with aggravated criminal sexual assault in connection to a September incident inside a Wheaton apartment, prosecutors have said.

Chet Magar and Pithakotey are each held in DuPage County Jail on $1 million bail, while Gyan Magar is held on $2 million. Chet Magar has requested a March 18 hearing to seek a reduction of his bail to $100,000.

In the motion, Chet Magar’s attorney states Magar has lived with his parents and siblings in Wheaton for the last five years after emigrating from Nepal. In that time, Magar has married and became a father in mid-February. Magar works as a laborer to support his family, the motion explains.

The Daily Herald reported Thursday Gyan Magar admitted he raped the 16-year-old girl victim in a text message, according to prosecutors.

Assistant State's Attorney Anne Therieau said Magar took the victim to an apartment in September. Magar began kissing the victim and when she told him to stop, Chet Magar and Pithakotey entered the room. Therieau said men then sexually assaulted her while Magar held her down by the shoulders, according to the Herald.

Prosecutors have not yet filed a formal response to the motion. Neither Gyan Magar nor Pithakotey have filed similar requests to reduce bail.

Court records show Pithakotey is on court supervision after pleading guilty in January to a misdemeanor battery charge stemming from a 2011 domestic violence incident with his wife. Prosecutors accused Pithakotey of slapping his wife in the face and hitting her in the stomach.

Every 5 second in humanbeings brain goes negative things.n does bad activities,accidently same thing happen to this 3 guys,i never heard any bad activities,that they did in past year,in fact they r really hard working guys,always working n supporting their family,has a excellent work history.specially chet magar,n dambar too,gyan magar is graduate student,he recently completed his course,n about to find a job n help his poor family,his father is disable,only mom working n paying all bills with lot ofproblem...chet was married

Chet magar was recently marrid n turns in to dad,his wife was so shocked n miss him every single time....same thing to dambar..this guys r from under developing asian country,nepal..they have no any knowledge,about laws of usa...so they commited a mistake,as a english saying says nobody is perfect in whole universe...god can do a mistake,i mean if person do a mistake he has to relize that he did mistake.....n he/she not gona do any mistake,n every body criminal,what ever get a golden chance to relize their mistake so there fore please the authorize person who were taking care of them.plz plz plz decrease their bond fee...coz they r from poor asian family.n give them one golden chance...god gona bless u...n u gona get bless from shocked family...i really miss those 3guys....working together n having a fun with them in past days makes me cry....jesus judge them n help them..every thing I subbmited in ur hand....help them help them help them...AMIN

And Dambar should of been home with his nine month pregnant wife not in his friends apt RAPING a helpless young girl who will probably be scarred for the rest of her life. At least they will get to go home in next 10-15 years and live a normal life.

What else i read the story and i can't say anythings but i hope if they get forgiveness after then i don't know what they do in future but perhaps may be they realised what to do and what not to do .in comming days...and they know what the consiquesce will be if they do same crime in future . .Hope so forgiveness is the greatest things in this world and Actually what i pefer is that give bless others people to get bless ourself .... same thing if we give forgiveness then we can also get forgiveness from god for simple misake anyway let me wish one thing that forgive those who really commited thier crime to get rid and give them chance to praise the lord with free mind and in free enviroment for evernal life and be blessed ,,,,,,,,,,,,,,,,,,,,,,,,,

Denisha yeah i do agree with you pujan..they should be forgiven because they are new to this country..n m sure dat they have realize their mistake ..as our heavenly father says forgive ur enemy so dat we will be forgiven..because of them lot of people are suffering like their children,parent,wife n their relatives..they may be the one to look after their family if they stay in jail then their family will get in trouble specaily their children..they should not get apart from their babies..jas leave evrythng in god..he will definately serve his son..bt dnt forget to pray n praise him

What a excuse? If criminals are excused agn n agn thy will get encourage to rape more other young and innocent girls. These nonsense guys should be severely punished as per law.

Are Rajesh, Denisha and Punjab related? Because they sure share the same writing style. Fancy that! If you hold down someone while they are being victimized, you are accountable. Was it peer pressure because his buddies told Chet that they're in this together? Because if you were part of this awful action, then you should also be willing to be part of the consequence.

that doesn't excuse them for what they did, they been here how long hello, they know whats illegal and whats not... i know one of them real good because he use to be my co-worker and he knows whats wrong and right... even at work he would ne doing thing he should been doing it i just feel sorry for his wife that she has to go thru this..
